Terms of Use
These Terms of Use (“Terms”) are a binding agreement between you and Risal E A (“we”, “us”, or the “Developer”), the developer of the Breathify mobile application (the “App”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. The App
Breathify provides structured breathing sessions (including Box Breathing, 4-7-8, Calm, Energy, and Focus patterns), visual pacer animations, ambient audio chimes, and haptic feedback to assist with mindfulness and relaxation. The App stores your session logs and preferences locally on your device.
2. Health and Medical Disclaimer
BREATHIFY PROVIDES GENERAL MINDFULNESS AND WELLNESS EXERCISES FOR RELAXATION AND FOCUS. THE APP DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, TREATMENT, OR THERAPY FOR ANY MEDICAL OR MENTAL HEALTH CONDITION.
- Consult a healthcare provider: Consult a qualified physician or healthcare professional before using the App if you have asthma, chronic obstructive pulmonary disease (COPD), cardiovascular conditions, high or low blood pressure, panic disorders, hyperventilation tendency, or if you are pregnant.
- Listen to your body: Do not strain or push past your comfort level during breathing exercises. If you experience dizziness, lightheadedness, shortness of breath, nausea, chest discomfort, or physical distress, stop the exercise immediately and return to normal, unforced breathing.
- Safety environment: Never perform breathing exercises while driving, operating heavy machinery, swimming, bathing, or in any environment where sudden dizziness could cause physical injury or accident.
- Mental health emergencies: Breathify is not a crisis intervention service. If you are experiencing a mental health emergency or severe distress, contact your local emergency services or a crisis helpline immediately.
3. Eligibility
You must be at least 13 years old to use the App. If you are under the age of majority in your jurisdiction, you may use the App only with the involvement and consent of a parent or legal guardian.
4. License
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use Breathify on Apple-branded devices that you own or control, for personal, non-commercial use in accordance with these Terms and Apple’s Media Services Terms and Conditions.
You agree not to:
- Copy, modify, adapt, translate, or create derivative works of the App or its audio visual assets;
- Decompile, reverse engineer, or attempt to extract the source code of the App;
- Circumvent or disable any subscription gating, licensing, or security features;
- Use the App for any illegal or unauthorized purpose.
5. Subscriptions and Billing
Certain premium breathing patterns, custom session timers, or advanced features may require an optional paid subscription or one-time purchase (“Breathify Pro”).
- Billing: Payment is charged to your Apple Account at confirmation of purchase.
- Auto-renewal: Subscriptions renew automatically unless cancelled at least 24 hours prior to the end of the current billing period. Renewal charges will be billed within 24 hours prior to period end.
- Managing & cancelling: Subscriptions may be managed or cancelled at any time in your device Settings (Settings → Apple ID → Subscriptions).
- Free trials: If a free trial is offered, cancelling before trial expiration prevents charges. Unused portions of a free trial are forfeited upon purchasing a subscription.
- Restoring purchases: Use the “Restore Purchases” option in the App settings to restore access on new devices.
6. Refunds
All purchases and transactions are processed directly by Apple. Refunds are governed strictly by Apple’s policies. To request a refund, submit a request via reportaproblem.apple.com.
7. Intellectual Property
The App, including its visual pacer design, animations, audio compositions, UI elements, branding, and text, is protected by intellectual property laws and owned by the Developer or its licensors. All rights not expressly granted are reserved.
8. Third-Party Services
Breathify uses standard Apple infrastructure for app distribution, payment validation, and update checks. Your use of the App is subject to applicable third-party terms. Review our Privacy Policy for data handling specifics.
9. Changes to the App and Terms
We reserve the right to modify or discontinue features in the App at any time, or update these Terms. Updated terms will be posted with a revised effective date. Continued use of Breathify following changes constitutes acceptance.
10. Termination
You may terminate this agreement by deleting the App from your device. We may revoke your license if you breach these Terms.
11. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BREATHIFY IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT BREATHIFY WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY OR HEALTH ISSUES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50 USD, WHICHEVER IS GREATER.
13. Indemnification
You agree to defend, indemnify, and hold harmless the Developer from any claims, damages, liabilities, and expenses arising out of your violation of these Terms or misuse of the App.
14. Governing Law
These Terms are governed by applicable local laws without regard to conflict of law rules. Any disputes shall be resolved in competent courts.
15. Apple-Specific Terms
These Terms are between you and the Developer only, not Apple Inc. Apple is not responsible for the App or its content, support, or maintenance. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
