Terms of Use (End User License Agreement)

1. Acceptance of Terms

Please read these Terms of Use (“Terms”, “Agreement”) carefully before downloading, installing, accessing, or using the Breathify mobile application, including any alternate application titles such as Pommi, our widgets, features, services, and associated content (collectively, the “App” or “Service”).

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not install, access, or use the App.

These Terms constitute a binding legal agreement between you (“User”, “you”) and Coowik. If you are using the App on an Apple iOS device, you also acknowledge that these Terms are concluded between you and Coowik only, and not with Apple Inc. (“Apple”). Coowik, not Apple, is solely responsible for the App and its content.

2. Health & Medical Disclaimer — Important Safety Notice

⚠️ PLEASE READ THIS SECTION CAREFULLY BEFORE USING BREATHIFY.

2.1 Not Medical or Psychiatric Advice

Breathify is designed solely as a digital wellness, mindfulness, and relaxation tool. The App provides visual, auditory, and haptic breathing pacers and educational breathing techniques (such as Box Breathing, 4-7-8, and diaphragmatic pacing).

  • Breathify is NOT a medical device and is not regulated, certified, or approved as a medical device by the U.S. Food and Drug Administration (FDA), European Medicines Agency (EMA), or any other regulatory health authority.
  • Breathify does NOT provide medical advice, diagnosis, treatment, or therapy. The App is not a substitute for clinical diagnosis, consultation, or treatment by a licensed physician, psychiatrist, psychologist, or healthcare professional.
  • The App does not claim to cure, prevent, or treat any medical, psychological, psychiatric, or respiratory condition, including but not limited to panic disorder, generalized anxiety disorder (GAD), clinical depression, asthma, chronic obstructive pulmonary disease (COPD), or sleep apnea.

2.2 Consult Your Healthcare Provider

You should consult your physician or healthcare provider before beginning any breathwork, meditation, or stress management regimen, particularly if you:

  • Have asthma, COPD, or any acute or chronic respiratory condition;
  • Have cardiovascular disease, high or low blood pressure, or a history of stroke or heart attack;
  • Have epilepsy, a seizure disorder, or a history of fainting (syncope);
  • Experience hyperventilation syndrome or panic-induced respiratory distress;
  • Are pregnant or nursing;
  • Have undergone recent thoracic, abdominal, or respiratory surgery.

2.3 Stop Immediately If You Feel Unwell

If at any point during a breathing exercise you experience dizziness, lightheadedness, nausea, shortness of breath, tingling in the extremities, rapid heartbeat, chest pain, or discomfort, STOP IMMEDIATELY, resume normal breathing, and rest. Do not force, strain, or prolong breath retention.

2.4 Environmental and Situational Safety

NEVER use Breathify while operating a motor vehicle, cycling, operating heavy machinery, swimming, bathing, or engaging in any activity where sudden dizziness, altered consciousness, or loss of attention could cause injury or death.

2.5 Emergency Medical Assistance

DO NOT rely on Breathify in a medical or psychological emergency. If you are experiencing a severe medical emergency, chest pain, severe shortness of breath, or thoughts of self-harm or suicide:

  • In the United States: Call 911 or call/text 988 (Suicide & Crisis Lifeline).
  • In the United Kingdom: Call 999 or 111.
  • In the European Union: Call 112.
  • In other regions: Immediately contact your local emergency response service or go to the nearest emergency room.

3. Eligibility & Age Restrictions

You must be at least 13 years of age (or the minimum legal age required in your country or jurisdiction to consent to using digital services without parental approval, such as 16 in certain EU member states) to use Breathify.

If you are between the ages of 13 and the legal age of majority in your jurisdiction, you represent and warrant that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. If you are under 13, you are strictly prohibited from using the App.

4. End User License (Apple App Store)

Subject to your continuous compliance with these Terms, Coowik grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable, and limited license to download, install, and use the App solely on Apple-branded products (iPhone, iPad, or other supported devices) that you own or control, in accordance with the Usage Rules set forth in Apple’s Media Services Terms and Conditions.

Restrictions on Use

You agree that you will not:

  1. Reverse engineer, decompile, disassemble, decrypt, or attempt to derive the source code of the App or any underlying algorithms;
  2. Modify, adapt, translate, enhance, or create derivative works based on the App;
  3. Rent, lease, lend, sell, sublicense, distribute, or commercially exploit the App or any portion thereof;
  4. Circumvent, disable, or tamper with any digital rights management, security components, or paywall mechanisms within the App;
  5. Use the App for any illegal, harmful, threatening, or fraudulent purpose.

5. In-App Purchases, Subscriptions & Billing

Breathify offers a free tier as well as premium features through Breathify Plus (also referred to as Pommi Plus), available via auto-renewable subscriptions and one-time in-app purchases.

5.1 Free vs. Plus Features

  • Free Tier: Includes access to core breathing patterns (e.g., CalMind, Box Breathing, 4-7-8 Sleep, Rescue), standard timers, basic streaks, and default widgets.
  • Plus Tier: Unlocks our complete breathing library (all advanced patterns), custom widget themes, alternate app icons, and extended analytics.

5.2 Auto-Renewable Subscriptions (Monthly / Yearly)

  • Payment & Billing: Payment will be charged to your Apple ID / iTunes Account upon confirmation of purchase.
  • Automatic Renewal: Subscriptions automatically renew for the same duration and price unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
  • Account Renewal Charges: Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the rate established for the chosen subscription plan.
  • Managing and Canceling Subscriptions: You can manage, modify, or cancel your subscription at any time through your iOS device settings:
    Open iOS Settings > Tap your Name / Apple ID > Subscriptions > Select Breathify / Pommi > Tap Cancel Subscription.
    If you cancel, your subscription will remain active until the end of your current paid billing period; you will not receive a partial refund for the remainder of the billing period.

5.3 Lifetime Purchases (Non-Consumable In-App Purchase)

  • We may offer one-time “Lifetime” in-app purchases (including promotional early-bird offerings).
  • A Lifetime purchase grants you permanent access to the unlocked Plus features in Breathify for the lifetime of the application on supported iOS devices linked to your Apple ID.
  • “Lifetime” refers to the commercial life cycle of the product and its availability on the App Store, not the lifetime of the purchaser.

5.4 Pricing & Price Changes

All prices, currencies, and applicable taxes are displayed in the App via Apple StoreKit and determined by Apple App Store regional pricing tiers. We reserve the right to adjust pricing for subscriptions or purchases at any time. Any price changes for auto-renewable subscriptions will take effect following notice from Apple, in accordance with Apple’s standard procedures.

5.5 Refunds

All financial transactions, payments, and refund requests are processed and governed exclusively by Apple in accordance with Apple’s Media Services Terms and Conditions. Coowik does not have access to your payment information and cannot directly issue refunds. If you wish to request a refund, please submit your request to Apple at reportaproblem.apple.com.

6. Intellectual Property Rights

The App, including but not limited to its design, user interface, visual layout, animations, breathing pacer graphics, custom sound chimes, haptic motifs, text, code, graphics, and trademarks, is the exclusive intellectual property of Coowik and is protected by copyright, trademark, and other applicable intellectual property laws.

You may not copy, reproduce, distribute, republish, download, perform, display, or transmit any part of the App without our prior written consent. All rights not expressly granted to you in these Terms are reserved by Coowik.

7. Privacy & Data Handling

Your privacy is paramount. Breathify is built with a local-first approach: your breathing session history, streak records, notification settings, and preferences are stored directly on your device. We do not require you to create an account, register an email, or sign in to use the App.

8. Third-Party Services and Apple Terms

8.1 Apple Acknowledgement

You acknowledge and agree that:

  1. These Terms are solely between you and Coowik, not Apple. Coowik is solely responsible for the App and its content.
  2. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
  3. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
  4. Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including product liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
  5. In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, Coowik, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
  6. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

8.2 Third-Party Analytics & Crash Diagnostics

The App integrates third-party services including Microsoft Clarity (session replay and analytics) and Firebase Crashlytics (crash reporting). Your use of the App is also subject to the relevant terms and privacy policies of these third-party providers as outlined in our Privacy Policy.

9. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP AND ALL ASSOCIATED SERVICES AND CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND.

COOWIK EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:

  1. THE APP WILL MEET YOUR PERSONAL HEALTH, WELLNESS, OR THERAPEUTIC REQUIREMENTS;
  2. THE OPERATION OF THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE;
  3. THE RESULTS OBTAINED FROM THE USE OF THE APP WILL BE ACCURATE, RELIABLE, OR MEDICALLY BENEFICIAL;
  4. ANY DEFECTS OR ERRORS IN THE APP WILL BE CORRECTED.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL COOWIK, ITS DEVELOPERS, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION:

  • DAMAGES FOR PERSONAL INJURY, PHYSICAL DISCOMFORT, EMOTIONAL DISTRESS, OR MEDICAL COMPLICATIONS ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP;
  • LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES;
  • ANY INTERRUPTION, SUSPENSION, OR TERMINATION OF THE APP;
  • ANY BUGS, VIRUSES, OR TECHNICAL GLITCHES TRANSMITTED THROUGH THE APP.

IN NO EVENT SHALL COOWIK’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP EXCEED THE AMOUNT ACTUALLY PAID BY YOU (IF ANY) TO COOWIK FOR ACCESS TO THE APP DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR TEN UNITED STATES DOLLARS ($10.00 USD), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITIES FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES; IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

11. Indemnification

You agree to defend, indemnify, and hold harmless Coowik, its contributors, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, expenses, and costs (including reasonable legal fees) arising out of or in any way connected with:

  1. Your access to or use of the App;
  2. Your violation of these Terms or any applicable laws or regulations;
  3. Your violation of any third-party right, including intellectual property, privacy, or publicity rights;
  4. Any physical, health, or emotional injury or distress claimed to result from breathwork or mindfulness practices undertaken while using the App.

12. Modifications to the App and Terms

12.1 Changes to the App

We reserve the right at any time to modify, suspend, update, or discontinue the App (or any part or feature thereof), temporarily or permanently, with or without notice. You agree that Coowik shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the App.

12.2 Changes to Terms

We may update or revise these Terms from time to time to reflect changes in our legal obligations, features, or business practices. When we post changes, we will update the “Last Updated” date at the top of this document. Continued use of the App following the posting of revised Terms constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using and uninstall the App.

13. Termination

These Terms remain in effect until terminated by either you or Coowik. You may terminate these Terms at any time by uninstalling the App and terminating all active subscriptions through Apple.

We may terminate or suspend your access to the App immediately, without prior notice or liability, if you breach any provision of these Terms or if we elect to cease operating the App. Upon termination, your right to use the App will immediately cease.

14. Severability and Waiver

  • Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable under applicable law, such provision shall be modified to accomplish the objectives of such provision to the greatest extent possible, and the remaining provisions shall continue in full force and effect.
  • No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.

15. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or related to them or the App shall be governed by and construed in accordance with the laws of the jurisdiction of the developer (excluding conflict of law principles), subject to mandatory consumer protection laws in your country of residence that cannot be waived by contract.

Any legal suit, action, or proceeding arising out of or related to these Terms or the App shall be resolved through good-faith negotiation. If a dispute cannot be resolved informally, it shall be submitted to the competent courts of the developer’s jurisdiction.
